A judge called the Pentagon's Anthropic blacklist illegal and baseless

A federal judge blocked the Pentagon from treating Anthropic as a national-security supply-chain risk. Reuters reports that U.S. District Judge Rita Lin found that the designation punished Anthropic for its public position on AI safety and violated the First Amendment. She also found that the government denied Anthropic the process required by the Fifth Amendment.

The dispute began after Anthropic refused to let the military use Claude for every lawful purpose. The company wanted to keep restrictions on mass surveillance of Americans and fully autonomous weapons. Defense Secretary Pete Hegseth then applied a procurement label designed to protect military systems from infiltration or sabotage. Reuters says this was the first public use of that designation against a U.S. company.

The ruling does not require the Pentagon to buy Claude or accept Anthropic's contract terms. The government can still choose another supplier. A separate case in Washington challenges another Pentagon method for excluding Anthropic and remains pending.

A private company's product policy is not a civil-rights law. The court limited how the government could punish Anthropic. It did not decide which military uses of AI should be legal, who should set those limits or how Congress should oversee them.

Watch whether the government appeals and how quickly agencies withdraw the supply-chain directives. The separate Washington case could set a different rule because it concerns another procurement power.

The next defense AI contracts should show whether suppliers can keep use restrictions without losing unrelated federal business. Congress could end the uncertainty by writing rules for domestic surveillance and autonomous weapons. Without those rules, each model vendor and procurement officer must negotiate the limits.
